Description of Contest: Woman-owned or co-owned small businesses will compete for the “Digital Growth Contest,” consisting of business communications services that could include high-speed Internet, digital telephone and/or television service; participation in a one-hour networking webinar conducted by a prominent entrepreneur; other prizes, depending on the market. The prizes will be provided by participating cable service providers (”Provider”), i.e. Charter Business, Comcast Business Class, Cox Business, Insight Business, Suddenlink Business and Time Warner Cable Business Class, as well as by Ladies Who Launch.
One (1) winner will be selected in each of the following designated serviceable areas (“Markets”) for that Provider*:
- Atlanta, GA – Comcast Business Class
- Chicago, IL – Comcast Business Class
- Cleveland-Akron, OH – Time Warner Cable Business Class
- Columbus, OH – Time Warner Cable Business Class
- Greenville, NC – Suddenlink Business
- Louisville, KY – Insight Business
- Minneapolis/St. Paul, MN – Comcast Business Class
- Orange County, CA – Cox Business
- Philadelphia, PA – Comcast Business Class
- Rhode Island – Cox Business
- Worcester, MA – Charter Business

The estimated aggregate value of the prizes for each winner is up to $12,000. The Contest is open to women who are legal residents of the fifty (50) United States and the District of Columbia, twenty-one (21) years of age or older and who are owners or co-owners of a small business (“Owner”) that employs between two (2) and fifty (50) persons at an external office (not a home office), that has been in operation for a minimum of three (3) years and is located in one of the Markets designated by the Providers.
Entering the Contest requires the submission of an essay of 250 words, or less, about a woman-owned or co-owned business -- emphasizing the opportunity, the challenges and the rewards of entrepreneurship. Each essay must also include an anecdote that illustrates how the business could benefit from an upgrade to its communications technology (e.g., faster Internet access, more telephone features, etc.) The business must be owned or co-owned by a woman entrepreneur, but anyone may submit the entry on behalf of or in support of a woman-owned business – a friend, employee, family member, customer or the entrepreneur herself. Subject to these Official Contest Rules, one (1) woman-owned business Grand Prize winner will be named in each Market. Each winner will be chosen by a panel of judges selected by CTAM and each Provider, and will receive prizes that could include one or more of the following products: high-speed Internet, digital phone and television service from the Provider, free of charge, for up to one year; participation in a one-hour networking webinar conducted by a prominent entrepreneur; and a feature on the Ladies Who Launch Web site at www.ladieswholaunch.com. The Provider prize for each winner includes twelve (12) months of free Provider services selected by Provider, with a maximum value up to $1,000.00 per month.
How To Enter: To enter the Contest online, you must obtain an Official Entry Form available at www.digitalgrowthcontest.com and complete all of the required information including the name of the owner or co-owner of the small business, the name of the small business, the business address (which must be located in a Provider-serviceable Market area listed above), the daytime and evening telephone number of the small business (or the person submitting the entry), an e-mail address, and a verification that the owner or co-owner is 21 years of age or older and agreement that the person submitting the entry is bound by these Official Rules. Submit your completed entry form with the essay of 250 words, or less, following the theme set forth above (see “Description of Contest”).
Alternatively, to enter via U.S. Mail, print and complete the Official Entry Form located at www.digitalgrowthcontest.com, and mail it with your original entry essay to Digital Growth Contest, Ketchum, 1230 Peachtree St., Suite 2100, Atlanta, GA 30309. All entries will be become the property of CTAM and none will be returned. The content of your entry essay must be entirely original. Your entry will also be disqualified if it contains pornographic, profane, indecent or obscene material of any kind or any subject matter that is unrelated to the small business.
All entries must be received between 12:01 a.m. Eastern Time ("ET") on Monday, October 14, 2008 and 11:59 p.m. ET on Monday November 13, 2008 ("Entry Period"). An individual may submit a maximum of one (1) entry per owner; however, if more than one person submits an entry for the same business, those entries will be combined for judging purposes.
Eligibility: The Contest is open only to woman owners or woman co-owners of a small business that employs between two (2) to fifty (50) persons with an external office (not a home office) that: (1) is located in a Provider Market (as defined above), (2) has no known structural, electric, or safety issues or defects, and (3) has at least two (2) standard, functional outlets. Contestant Owners or Co-Owners must be twenty-one (21) years of age or older, own or co-own the small business being entered into this Contest, and be a legal resident of the 50 United States or the District of Columbia at time of entry. Employees of Providers, CTAM and Ketchum Inc. and each of their respective parent companies, subsidiaries, affiliates, sales representatives, agencies, retailers, wholesalers, distributors, and promotional and other vendor agencies involved in this Contest (collectively, the “Contest Entities”) are NOT eligible to enter or win. The immediate family members (parents, spouses, children, siblings) of such employees and all others with whom they are domiciled are also ineligible to participate in the Contest. The Contest is subject to all federal, state and local laws and regulations and is void where prohibited or restricted by law. Grand Prize Winner Judging Criteria, Selection and Notification. All eligible entries will be evaluated by a panel of judges consisting of representatives of CTAM, the Providers and others designated by CTAM and Providers in accordance with the judging criteria described below. CTAM and Providers will not be responsible for any loss or damage to your entry essay and your entry will not be considered if any portion of your entry form is incomplete or illegible. At CTAM’s discretion, entry essays may be posted on the CTAM website located at www.digitalgrowthcontest.com. The judging panel will consist of representatives from CTAM, Providers and others designated by CTAM and Providers. All decisions of the judging panel are final and binding.
The entry with the highest point total as determined by the Contest judges will be selected as the potential Grand Prize Winner for each Market, subject to confirmation of eligibility and compliance with these Official Rules. In the event of a tie in point totals, the judges will re-evaluate the tied entries and select the entry that best reflects all Contest criteria as a whole. On or about November 30, 2008, the potential Grand Prize Winner for each Market will be notified by phone and/or express mail at CTAM’s and Providers’ discretion. If the potential Grand Prize Winner cannot be reached and a message is left, the potential winner will be required to return the call within 24 hours of notification to accept the prize. If the call is not returned within 24 hours, CTAM and Provider may disqualify the potential Grand Prize Winner, declare her interest in the prize forfeited and select a substitute potential winner from among all remaining eligible entries using the same judging criteria described below. The potential Grand Prize Winner must execute an Affidavit of Eligibility, Publicity Release and Liability Release and any required tax documents within eight (8) calendar days of CTAM’s or Provider’s first attempted notification. Failure to timely execute and return these documents may, at the discretion of CTAM or Provider, result in the potential winner’s disqualification, the forfeiture of her interest in the Grand Prize and the selection of a substitute winner. Proof of eligibility will be required.
The Grand Prize winner will be the owner or co-owner of the woman-owned small business being nominated; only the owner or co-owner will receive the Grand Prize.
Judging Criteria: The judging criteria will be based on a twenty-five (25)-point rating system. Specific categories include:
- Opportunity – Why was the business founded?
- Challenges – What struggles has the entrepreneur faced in starting or building her business?
- Rewards – How has the entrepreneur addressed those challenges, and succeeded?
- Inspiration – Does the entrepreneur’s story showcase innovation and/or perseverance that can serve as inspiration for other entrepreneurs?
- Technology – Illustrate how the lack of robust communications technology has negatively impacted the entrepreneur’s business. How might the entrepreneur benefit from an upgrade to Internet, telephone or other communications services?
A total of five (5) points can be received for each of these five categories, adding up to a potential maximum score of twenty (25) points, as determined by the Contest judges in their sole discretion.
Grand Prize and Approximate Retail Value: The Grand Prize could include one or more of the following products: high-speed Internet, digital phone and/or television service provided by the “Provider,” free of charge, for up to one year; along with other prizes, depending on the Market. The Grand Prize will consist of installation and provision of Provider’s technical services in the Grand Prize Winner’s office space listed on the entry form. The Grand Prize consists of the following components: (1) Provider’s analysis of the Grand Prize Winner’s current technology and business applications, (2) the preparation of a proposal for the addition of relevant Provider technical services, and (3) the installation and provision for twelve (12) months of Provider services selected by Provider in its sole discretion with a maximum value of $1,000.00 per month in monthly recurring charges. Grand Prize winners need not be an existing Provider subscriber to win the Grand Prize; some restrictions apply. The Grand Prize Winner may not receive Provider subscription portion of prize unless (1) her business is located within the activated service area of Provider as determined by Provider and the Grand Prize Winner qualifies for “standard installation” as defined by the franchise agreement granted by the city in which the Market is located, and (2) the Grand Prize Winner signs or has signed a standard subscription agreement of Provider.
Other prizes will include: (1) Participation in a one-hour networking webinar conducted by a prominent entrepreneur; and a feature on the Ladies Who Launch Web site at www.ladieswholaunch.com. Provider’s installation of services is subject to any structural, building code, or other physical or legal restrictions that may prevent the makeover from being completed as described. The Grand Prize Winner agrees to cooperate in obtaining any required licenses or permits necessary to facilitate the installation of the prize services. Grand Prize Winner is also responsible for all charges for services ordered from Provider that exceed the monthly service fee allowance included in the Grand Prize and all services received from Sponsor, including services included in the Grand Prize, may be terminated in the event of late or non-payment for such additional services.
Approximate Retail Value (A.R.V.) of each Grand Prize varies by Market. Specific Grand Prize component values may vary considerably depending on the winner’s specific needs and location.
Any required taxes on the Grand Prize are the sole responsibility of the Grand Prize Winner. Prizes are non-transferable and no substitution or cash equivalent is allowed except in Provider’s sole discretion. Grand Prize Winner will be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certificate). Sponsor and Provider reserve the right to substitute prizes of the same approximate retail value should a prize offered become unavailable for any reason. Grand Prize consists only of items specifically listed as part of the prize. All costs and expenses not specified herein, related to any prize, including but not limited to delivery, installation, service activation fees and other expenses incurred by accepting the prize are the sole responsibility of the Grand Prize Winner.
Assignment of Rights: By entering the Contest, you grant to the Contest Entities a non-exclusive, perpetual, royalty-free, fully paid up license to make use of and distribute your essay submitted hereunder, as well your name, voice, likeness and appearance therein (if any) and the personally identifying information you provide on or in connection therewith (collectively, the "Content Submission"), as further described below. You acknowledge and agree that you shall not be entitled to share in any revenue that the Contest Entities may or may not earn or generate through its use of your Content Submission.
Contest Entities’ Right to Use Owner’s Contest Submission. By entering the Contest, you grant the Contest Entities the non-exclusive right to edit in any manner, and to use and distribute and license others to use and distribute, your Content Submission, or any portions, reproductions or versions thereof, on the websites, products and/or services (in any and all media, now known or hereafter invented, including without limitation television, home video/DVD products, and mobile services) of the Contest Entities, an unlimited number of times, in perpetuity, throughout the world, with or without charge or cost to end-users or other third parties. You also grant the Contest Entities the right to use and distribute, and license others to use and distribute, your Content Submission in the promotion of such websites, products and/or services, to the same extent permitted for use and distribution of your Content Submission hereunder.
Clearance of Your Content Submission for the Contest Entities’ Use: You represent and warrant that your Content Submission is your original work and that you have secured any and all rights, releases and permissions necessary for the Contest Entities’ use and distribution of your Content Submission hereunder, including without limitation those related to any people, places, music, performances of dance or music, video, photographs and/or graphics in your Content Submission (collectively, the "Elements"). You represent and warrant that, to the best of your knowledge, no further permissions or fees are due for the Contest Entities’ use and distribution of your Content Submission or any Elements therein. You further represent and warrant that any statements made by you or others in the Content Submission are true to the best of your knowledge and that neither they, nor any Element of your Content Submission, will violate any law or regulation or violate or infringe upon the rights of any third party.
Waiver of Right of Approval: By entering the Contest, you waive any right of inspection or approval of your Content Submission as used and distributed by the Contest Entities, including without limitation, any approval of your appearance and/or use of your name therewith or the uses to which either may be put.
Release and Waiver; Indemnification: You acknowledge that the Contest Entities will rely on the foregoing terms and conditions potentially at substantial cost to them, and you hereby waive the right to assert any claim of any nature whatsoever against any party relating to the exercise of the rights and permissions granted hereunder. By entering the Contest, you agree to indemnify, defend and hold harmless the Contest Entities from any and all claims arising from their use and distribution of your Content Submission as permitted herein.
Online Registration: If for any reason the Contest, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Contest, Contest Entities reserve the right at their discretion to disqualify any individual and Contest Entities further reserve the right to cancel, terminate, modify or suspend the Contest. If the Contest is terminated before the designated end date, Contest Entities will (if possible) select the Grand Prize winner from among all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Contest Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Contest Entities are not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Provider due to technical problem or traffic, congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, CTAM RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Contest entries generated by a script, macro or other mechanical or automated means are ineligible and will be disqualified. All entries must include a valid e-mail address for the entrant. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of the entry. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
Release of Liability: By entering, you agree to accept and abide by these Official Rules and the decisions of the Contest Entities and agree that any dispute with regard to the conduct of this Contest, rule interpretation or award of prize, shall be resolved by Contest Entities, whose decisions shall be binding and final. By participating, you agree to release and hold harmless the Contest Entities from any injury, loss or damage to person, including death, or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of a prize, participation in any Contest-related activity, or participation in the Contest. Contest Entities are not responsible for any typographical or other error in the printing of this offer, administration of the Contest or in the announcement of prizes, including such error as may give an erroneous indication that a prize has been won. In the event Contest Entities are prevented from continuing with this Contest or the integrity and/or feasibility of the Contest is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Contest Entities’ control (each a "Force Majeure" event), Contest Entities shall have the right, in their discretion, to abbreviate, modify, suspend, cancel or terminate the Contest without notice or further obligation. If Contest Entities, in their discretion, elect to abbreviate the Contest as a result of a Force Majeure event, the Contest Entities reserve the right, but shall have no obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event. All entries are the property of Sponsor/Provider Parties and are not returnable.
